This website is operated by You Are The Star Limited (“YATS”, “we”, “us” or “our”). Throughout the site, the terms “we”, “us” and “our” refer to You Are The Star Limited. These Terms of Service (the “Terms”) govern your use of the Site (https://youarethestarbooks.com) and any purchase you make from us.

By visiting our Site and/or purchasing something from us, you agree to be bound by these Terms and by any additional terms and policies referenced herein (including our Privacy Policy and our Refund & Returns Policy). If you do not agree to these Terms, you must not use the Site or purchase products or Services from us.

1. Acceptance & Eligibility

By placing an order you represent that you are at least 18 years old or the age of majority in your jurisdiction and that you have the legal capacity to enter into these Terms. If you are ordering on behalf of someone else (for example buying a personalised book for a child) you confirm that you are the child’s parent, legal guardian or authorised adult and that you are providing any child personalisation information with the right to do so.

2. Changes to these Terms

We may update these Terms from time to time. The current version of the Terms will be published at this page. It is your responsibility to check this page periodically for changes. Continued use of the Site after changes are posted constitutes your acceptance of those changes.

3. Account & Security

If you create an account on the Site, you agree to (a) provide accurate, current and complete information, and (b) update such information as needed. You are responsible for safeguarding your account login details and for any activity under your account. Notify us immediately at support@youarethestarbooks.com if you suspect unauthorised use.

4. Orders, Pricing & Payment

All prices shown on the Site are in the currency displayed and are subject to change without notice. We reserve the right to limit quantities, refuse or cancel any order for any reason (including errors in price or product information). Payment is taken by the payment provider you select at checkout (for example Stripe or Shopify Payments) and payment details are processed by that provider. We do not hold your full card details.

5. Personalisation & Children’s Data

When you order a personalised product you will be asked to supply information to personalise the book (for example the child’s name, age or year of birth, hometown, avatar choices and any personalised text). By providing child personalisation data you confirm that:

• You are an adult (the child’s parent, guardian or authorised purchaser);
• The information you supply is accurate and that you have the right to provide it;
• You consent to our processing of that data to create and deliver the personalised product in accordance with our Privacy Policy.

You are responsible for the accuracy of any personalisation data you provide. We are not responsible for errors caused by incorrect information submitted by you. If you provide personalisation information by chat (Shopify Inbox), email or phone you confirm you are an adult and authorise us to use that information to fulfil the order.

6. Live Chat & Support (Shopify Inbox)

We operate live chat via Shopify Inbox to help with orders and support. Chat transcripts and attachments may be recorded and retained (see our Privacy Policy for details). Chat is intended for use by adult purchasers and authorised contacts only. Do not share a child’s personal data in chat unless you are the child’s parent or legal guardian.

7. SmartMark, Physical Devices & Safety

Some products (for example SmartMarks or other NFC-enabled bookmarks) are physical devices intended to interact with our digital services. If you purchase such a product you acknowledge and agree that:

• SmartMarks are physical items with electronic components and should be used under adult supervision. They are not a substitute for adult supervision and are not toys for unsupervised use by young children.
• We provide instructions for safe use; you must follow those instructions and local safety guidance.
• SmartMarks are provided “as is” subject to any limited warranty described on the product page. We are not liable for damage caused by misuse, modification or incorrect handling of physical products.
• If a SmartMark is lost, damaged or malfunctions due to wear-and-tear or misuse, replacement may be offered under our Returns & Refund Policy at our discretion.

8. Shipping, Delivery & Risk

Shipping times are estimates and commence from the date of dispatch. We are not responsible for delays caused by carriers (including weather, customs clearance or force majeure). Title and risk in physical products pass to you on delivery. For international orders you are responsible for any customs duties and taxes.

9. Refunds, Returns & Cancellations

Returns and refunds are subject to our Refund & Returns Policy. Personalised products are typically non-refundable except where faulty or materially not as described. If you believe a product is defective or incorrectly personalised, contact us promptly at support@youarethestarbooks.com.

10. Intellectual Property

All content on the Site (text, images, logos, designs, page layouts and code) is owned or licensed by YATS. You may view and print pages for personal, non-commercial use only. You may not reproduce, copy, modify, distribute, display or create derivative works from any content without our prior written permission. If you upload or submit content to the Site, you grant YATS a perpetual, irrevocable, royalty-free, worldwide licence to use, reproduce and display that content in connection with the Site and our business.

11. User Content

If you submit any content, including reviews, messages, suggestions or material for personalisation, you warrant that you own or control the rights to that content and that it does not violate these Terms (including third-party IP, privacy or publicity rights). We may remove or refuse any content at our discretion.

12. Prohibited Uses

You must not misuse the Site or Services (including by transmitting viruses, spamming, scraping, attempting unauthorised access, sending unlawful, pornographic or abusive content, or infringing third-party rights). We reserve the right to suspend or terminate your access for prohibited use.

13. Third-Party Services & Links

The Site may contain links to third-party websites and may use third-party services (payment processors, fulfilment partners, analytics, chat providers). Those third parties have their own terms and privacy policies. We are not responsible for their content or compliance; please review their terms before interacting with them.

14. Disclaimers, Warranties & Limitation of Liability

To the maximum extent permitted by law, the Site and all products and Services are provided “as is” and “as available” without warranties of any kind. We disclaim all implied warranties including merchantability and fitness for a particular purpose.

Except as may be prohibited by applicable law, in no event will YATS or its officers, directors, employees, agents, suppliers or licensors be liable for any indirect, incidental, special, consequential or punitive damages (including loss of profits, loss of data, or business interruption) arising out of or in connection with these Terms or your use of the Site, even if we have been advised of the possibility of such damages. Our aggregate liability for direct damages shall not exceed the price you paid for the product or service giving rise to the claim (or £100 where no purchase was made), except where prohibited by law.

15. Indemnification

You agree to indemnify and hold YATS and its affiliates harmless from any claim, demand, loss, liability or expense (including legal fees) arising out of your breach of these Terms, your misuse of the Site, your violation of any law, or your infringement of any third-party rights.

16. Termination

We may suspend or terminate your access to the Site for any reason, including breach of these Terms. Termination does not affect our rights or remedies for events that occurred prior to termination.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted and the remainder of the Terms will remain in full force and effect.

18. Governing Law & Dispute Resolution

These Terms and any dispute arising out of or related to them shall be governed by and construed in accordance with the laws of England and Wales. You and YATS agree to submit to the exclusive jurisdiction of the courts of England and Wales for any dispute that cannot be resolved informally.

19. Changes to the Service

We may change, suspend or discontinue any aspect of the Site or Services at any time. We will not be liable to you or any third-party for any change, suspension or discontinuance.

20. Entire Agreement

These Terms, together with our Privacy Policy and Refund & Returns Policy, constitute the entire agreement between you and YATS regarding your use of the Site and supersede any prior or contemporaneous agreements.
