1. Introduction

1.1 These Terms & Conditions ("Terms") govern your access to and use of the YATS Universe application and services (the “Service”) provided by YOU ARE THE STAR LIMITED (“we”, “us”, “our”). By creating an account, accessing or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1.2 The Service is intended for entertainment: users may create an avatar and read a series of short stories. The features and content available may change from time to time.

2. Eligibility, Age & Parental Consent

2.1 Users aged 13 or older. If you are 13 years of age or older, you may create an account and use the Service subject to these Terms.

2.2 Users under 13. If you are under 13 years of age you may only use the Service where a parent or legal guardian (“Parent”) has first created and verified a Parent account and has attached and verified the child’s account. The Parent must give verifiable parental consent as required by applicable law (including UK/EEA data protection laws) before the child may use the Service.

2.3 Parent responsibilities. Parents who create and verify an account accept responsibility for their child’s use of the Service, including supervising the child’s activity and complying with these Terms. Parents may withdraw consent, request account deletion, or exercise data subject rights on behalf of their child by contacting us as set out in Section 12.

2.4 False information. You must not misrepresent your age or identity. If we become aware that a child under 13 is using the Service without verified parental consent, we will delete the child’s personal data and/or terminate the account as required by law.

3. Account Registration & Verification

3.1 To register you must provide a valid email address. We only capture and store users’ email addresses (see Section 5). You are responsible for keeping your login details secure. If you suspect your account has been compromised you must tell us immediately.

3.2 For children under 13, the Parent will be required to verify (for example by email confirmation) their identity and consent before the child can access the Service. We will not permit access until verification is complete.

3.3 You must not allow others to use your account. We reserve the right to suspend or terminate accounts for violations of these Terms or for suspicious activity.

4. What You Can Do on the Service

4.1 The Service allows users to:

  • Create and customise an avatar (visual character representation);

  • Read a series of short stories provided through the Service.

4.2 You retain ownership of any original content you create (for example avatar designs you create). By using the Service you grant us a non-exclusive, worldwide, royalty-free licence to store, display and use your avatar and any user-supplied content to provide the Service, to operate and improve the Service and for promotional purposes in accordance with our Privacy Policy.

4.3 You agree not to create avatars or submit content that is unlawful, defamatory, sexually explicit, violent, hateful, or otherwise offensive. We may remove or refuse to display any content that breaches these Terms.

5. Personal Data & Privacy

5.1 What we collect. We only capture and store users’ email addresses. We use the email address to create and manage accounts, to verify parental consent when required, to send essential communications about the Service and for security purposes.

5.2 Other data. We may temporarily process technical data (for example device identifiers, crash logs or session data) strictly to operate, secure and improve the Service. We do not store other personal data about child users beyond the email address except as required to operate the Service or as permitted by law. Aggregated or anonymised usage data may be retained and used to improve the Service.

5.3 Data sharing. We will not sell your personal data. We may share email addresses with trusted third-party service providers who process data on our behalf (for example email delivery providers), and we require those providers to safeguard data and use it only to provide services to us.

5.4 Retention. We retain your email address for as long as your account exists and for a reasonable period afterwards to comply with legal obligations and resolve disputes. Parents may request deletion of a child’s account and data (see Section 12).

5.5 For full details on how we use personal data and your rights, please read our Privacy Policy [link to privacy policy]. If you are a Parent acting for a child, you may exercise your child’s data rights as described in that policy.

6. Acceptable Use

6.1 You agree to use the Service only for lawful purposes and in accordance with these Terms.

6.2 You must not:

  • Use the Service to post or transmit unlawful, harassing, libellous, abusive, threatening, pornographic, obscene or otherwise objectionable content;

  • Attempt to gain unauthorised access to other accounts, systems or networks;

  • Reverse engineer, decompile or otherwise attempt to derive source code or underlying data from the Service;

  • Interfere with or disrupt the integrity or performance of the Service.

6.3 We may suspend or terminate your account if you breach this Section.

7. Intellectual Property

7.1 All intellectual property rights in the Service, the short stories and the underlying software, graphics, designs and trademarks are owned by or licensed to YOU ARE THE STAR LIMITED. You do not acquire any ownership rights to the Service by using it.

7.2 If you create original material (avatars or other user content), you own the copyright in those creations but grant us the licence in Section 4.2.

8. Modifications to the Service & Terms

8.1 We may change or discontinue the Service (or any part of it) at any time. We will try to give advance notice of material changes.

8.2 We may update these Terms from time to time. If the changes are material, we will notify you by email or by posting a notice on the Service. Your continued use of the Service after the changes means you accept the revised Terms.

9. Suspension & Termination

9.1 We may suspend or terminate your access to the Service at any time and for any reason, including violation of these Terms.

9.2 On termination we will close your account and, where legally required or requested by you or a verified Parent, delete the user’s email address and other personal data in accordance with our Privacy Policy and applicable law.

10. Disclaimers & Limitation of Liability

10.1 Disclaimer. The Service is provided “as is” and “as available.” We make reasonable efforts to provide the Service reliably but do not guarantee uninterrupted or error-free operation.

10.2 Limitation of Liability. To the maximum extent permitted by law, we and our officers, employees, agents and suppliers shall not be liable for indirect, incidental, consequential, special or punitive damages arising out of or related to these Terms or your use of the Service. Our total aggregate liability for direct loss or damage arising out of or in connection with these Terms shall be limited to the amount you have paid to us in the 12 months prior to the event giving rise to liability (if any); where you have not paid us any amount, our aggregate liability shall be limited to £50. Nothing in these Terms limits liability for death or personal injury resulting from our negligence or for any liability that cannot be excluded by applicable law.

11.2 If you are dissatisfied with our response related to personal data, you have the right to lodge a complaint with the UK Information Commissioner’s Office (ICO) or other supervisory authority.

12. Your Rights (Data Protection)

12.1 Subject to verification and applicable law, you (or a Parent acting for a child) may request access to, correction of, or deletion of personal data we hold. To exercise these rights contact us at the email address in Section 11. We will respond in accordance with applicable law.

13. General

13.1 Severability. If any provision of these Terms is held to be invalid or unenforceable that provision will be struck out and the remainder will continue in full force.

13.2 Entire agreement. These Terms, together with any documents expressly referred to in them (including our Privacy Policy), constitute the entire agreement between you and us in relation to your use of the Service.

13.3 Governing law. These Terms are governed by the laws of England and Wales. You and we both agree that the courts of England and Wales will have non-exclusive jurisdiction to resolve any dispute.
